Description | The presentation introduces the system of exceptions and limitations of copyright in Czech law and the approaches to their interpretation. The first part presents the theoretical basis of the exceptions and limitations in the European and Czech copyright law as well as their justifications, namely the fundamental human rights and freedoms. This theoretical analysis then serves as a basis for discussing interpretative approaches to exceptions and limitations. Subsequently, two of these basic approaches are introduced and discussed, namely a restrictive one (represented in the Czech Republic, eg by Prchal [1]) and liberal extensions (represented by foreign legal science and Husovec [2]). These approaches are demonstrated on the current case law of the national courts and the Court of Justice of the European Union. Attention is also paid to the three-step test and the approaches to its application (§ 29 Copyright Code) as well as its possible use in order to achieve greater flexibility of the entire copyright system.
